Please read before ordering. By reserving, paying for, accepting delivery of, or using Hoosier Totes equipment, you agree to these Terms and your order confirmation. If you book for a company or another person, you confirm that you have authority to accept for them.
1Agreement and eligibility
These Rental Terms & Conditions (the "Terms") are between Hoosier Totes ("Hoosier Totes," "we," "us," or "our") and the person or organization named on the order ("Customer," "you," or "your"). You must be at least 18 years old and legally able to enter a contract.
Your agreement includes these Terms, the order confirmation, any accepted business quote, and any written change confirmed by us. The order or accepted quote controls if it contains a different quantity, date, location, or price.
2Equipment and ownership
"Equipment" includes all reusable totes, lids, dollies, labels, and other accessories supplied by Hoosier Totes. Equipment remains our exclusive property at all times. This is a rental only; you may not sell, pledge, sublease, transfer, alter, or abandon it.
3Rental period and extensions
Your rental begins on the confirmed delivery date and ends only when all Equipment has been successfully collected by us. Standard rental choices are two, three, or four weeks, as shown in your order.
- Request an extension before your scheduled pickup. Extensions require our written confirmation, are subject to availability, and are charged at the rate we confirm.
- An early pickup does not shorten the booked rental or create a prorated refund after delivery.
- Keeping Equipment without an approved extension may result in late and additional-trip charges listed below.
4Delivery, pickup, and access
Unless your checkout or quote states otherwise, package pricing includes one delivery trip and one pickup trip within our core service area of South Bend and Mishawaka. Service in Granger, Elkhart, and other areas is subject to availability and may include a distance charge disclosed before booking.
- You must provide accurate addresses, contact information, parking instructions, gate codes, elevator reservations, and building permissions.
- Our standard service is to a safe, legal, reasonably accessible exterior, ground-floor, garage, loading-area, or elevator-accessible location. Inside carrying, stairs, long carries, or restricted access require advance approval and may cost extra.
- An adult must be available unless we have approved unattended delivery or pickup in writing. You accept responsibility for Equipment left at an approved unattended location.
- For pickup, Equipment must be empty, dry, nested, countable, and accessible at the confirmed location.
- Arrival windows are estimates. Weather, traffic, safety conditions, and events outside our reasonable control may require a new time.
5Inspection and acceptance
We deliver Equipment clean, sanitized, and serviceable. Ordinary cosmetic marks do not make a tote unusable. Count and inspect the Equipment when it arrives. Report a shortage or existing damage, with photos when practical, within 24 hours of delivery. Otherwise, the Equipment will be considered received in the quantity and condition shown on the order.
6Safe use and equipment care
You are responsible for the Equipment from delivery until successful pickup. Keep it secure, reasonably dry, and protected from theft, weather, pests, and misuse. Use it only for ordinary household, dorm, office, or commercial moving and temporary storage.
You may not:
- Pack illegal, explosive, flammable, corrosive, toxic, biohazardous, or otherwise dangerous materials.
- Pack leaking liquids, wet items, uncovered food, garbage, animals, pest-infested items, paint, oil, chemicals, or anything likely to stain, contaminate, or create a persistent odor.
- Drill, cut, paint, mark, modify, or apply permanent adhesive. Use only labels we provide or removable materials we approve.
- Stand, sit, ride, or climb on totes or dollies; exceed a posted or communicated load limit; or use Equipment for a purpose for which it was not designed.
- Move Equipment outside the agreed locations or lend it to someone else without our written approval.
You are responsible for safe packing, lifting, stacking, securing loads, and use of dollies. Children and pets should be kept away while Equipment is moved or stacked.
7Return condition, loss, and damage
Normal sanitizing is included. Return all Equipment empty, reasonably clean and dry, and free of debris, residue, unauthorized adhesive, strong odors, pests, and contamination. You are responsible for loss, theft, destruction, and damage beyond ordinary wear while the Equipment is in your custody.
We may photograph or count Equipment at delivery and pickup for condition and inventory records. If we identify loss, damage, or extra cleaning after pickup, we will send an itemized notice to the email on your order. Equipment not returned within 30 days after the scheduled pickup, after reasonable attempts to contact you, may be treated as lost and charged at the replacement rate. It remains our property even after a charge.
8Additional fee schedule
These charges apply only when the described event occurs. Taxes may apply. We may waive or reduce a charge when circumstances reasonably warrant it.

Late charges stop when all Equipment is recovered or replacement charges are assessed. Charges are not intended to exceed our reasonable loss, service, cleaning, or recovery costs.
9Schedule changes and cancellations
Contact us as soon as plans change. Reasonable schedule changes requested before route dispatch are normally made without a fee, subject to availability. A $35 extra-trip fee may apply if a change is requested after dispatch, our team arrives without safe access, no authorized recipient is present, or Equipment is not ready for pickup.
Cancel at least 48 hours before the confirmed delivery for a refund of amounts paid, less any nonrefundable custom or third-party charge disclosed in advance. A cancellation within 48 hours is subject to the $50 charge above. After Equipment is dispatched or delivered, the booked rental charge is nonrefundable. Different terms stated in an accepted commercial quote control for that order.
10Payment and card authorization
You agree to pay the rental price, taxes, disclosed delivery charges, and any additional amount properly due under these Terms. You authorize Hoosier Totes and its payment processor to charge the payment method provided for the original order and for confirmed extensions, late retention, failed trips, cleaning, loss, damage, and other charges described here. We will provide an itemized notice for post-rental charges.
Your payment information is handled by our payment processor under its security and privacy practices. A disputed or reversed payment does not cancel a valid payment obligation.
11Your belongings and third-party movers
Hoosier Totes rents Equipment; we do not pack, load, transport, insure, or take custody of your belongings. You are responsible for choosing what to pack and for protecting, securing, transporting, and insuring your property. We are not responsible for loss of or damage to contents, vehicles, floors, walls, buildings, or other property caused by packing, lifting, stacking, transport, weather exposure after delivery, or the acts of you, your movers, employees, contractors, or guests.
12Business and organizational rentals
The person placing a business order represents that they are authorized to bind the organization. The Customer is responsible for use by its employees, contractors, movers, occupants, and agents. Any accepted commercial quote, statement of work, or written account terms may add to or modify these Terms for that rental.
13Risk, warranties, and limitation of liability
You assume the ordinary risks of packing, lifting, stacking, moving, and storing items and agree to follow all safety instructions. To the fullest extent allowed by law, Equipment is provided "as is" and "as available," except that we will use reasonable care to provide clean, serviceable Equipment.
To the fullest extent allowed by law, Hoosier Totes will not be liable for indirect, incidental, special, punitive, or consequential damages, lost profits, lost business, or loss of data. Our total liability arising from a rental will not exceed the amount you paid for that rental. These limits do not apply where prohibited by law or to loss caused by our gross negligence or willful misconduct.
You agree to reimburse and defend Hoosier Totes from third-party claims and reasonable costs caused by your breach of these Terms, unlawful conduct, or misuse of Equipment, except to the extent caused by our negligence or willful misconduct.
14Delays and events beyond our control
Neither party is responsible for delay caused by severe weather, unsafe roads, fire, flood, utility or technology failure, government action, labor disruption, vehicle breakdown despite reasonable maintenance, or another event outside reasonable control. We will communicate promptly and reschedule affected service. This section does not excuse payment obligations already due.
15Electronic communications and acceptance
You agree that we may send order confirmations, invoices, delivery and pickup updates, and other transactional messages by email, phone, or text using the contact information you provide. Message and data rates may apply. Consent to marketing is separate and is not required to rent.
Checking an acceptance box, submitting an order, signing electronically, paying, or accepting delivery is an electronic signature and has the same effect as a handwritten signature.
16Indiana law and general terms
Indiana law governs these Terms, without regard to conflict-of-law rules. Any court proceeding must be brought in a state or federal court serving St. Joseph County, Indiana, except that either party may bring an eligible claim in small claims court.
If one provision is unenforceable, the rest remains effective. A delay in enforcing a right is not a waiver. You may not assign your rental without our written consent. These Terms and the applicable order documents are the entire agreement about the rental and replace prior discussions about the same subject.
The version in effect when you book governs that rental. We may update these Terms for future rentals by posting a new effective date. A material change to an existing order requires written agreement.
